At that time, I was assured that "we share your " - " " * = = = " " = " deep concern about the safety of alI nuclear reactors and nave many large programs in place to assure that reactor operations in this country can proceed with acceptable , m . . . . . risk to the public" and that "we are not relaxing these = --- standards in the case of the CRBRP project". It would be unfortunate if, at this point, you wiped out your gafns as an agency truly concerned with the sm26 and welfare of all the people of this country. In 1975 the AEC brushed aside NEPA and determined that contracts could be signed and i=plemented without an Environmental Impact Statement coveri36 the entire breeder reactor program which CRBR was to usher in. In fact, ERDA had requested-$181 million for the CRBR without even filing any EIS. In the light of the 1973 confidential internal :nomorandom of Burns and Roe, Inc., the architect-Engineers of the Clinch River Breeder Reactor, one would hope that the NRC would want to pay particular attention to site clearing andexcavationratherthanexemptingtheconsortiumfrcaruls10C7R50,10/ The Burns and Roe memorandum, aside from charging unreliable ma q emest, neglect of important safety problems, diversien of funds, etc., specifically said of the site of the CRBR that " varying rock conditions", " voids and cavities", and - - Tope stability" ... made it one of the worst sites ever selected for a nuolear

And it is a fact that in spite of Burns and Roe's list of serious complaints against the project the firm remained committed to its development, 1 an understandable position when ERDA announced That Burns and Roe had been. ~ paid $37,4 million in fees as of September d 30, 1976. This, however, will - not chan6e basic topography, rock formations, voids and cavities, and landslide propensities in the cite - which merit your attention, not an exemption. There was a time when there may have been genuine concern about the sufficiency of the supply of Uranium for the existing and to come IJFR's, which would necessitate reprocessing and breeder reactors. Doubt is cast on this, however, an view of the fact that the shortage figures came frem the AEC, and the AEC's known interest in the breeder from the very beginning of the peaceful use of the aton for energy. It OK'd the Fermi commercial denonstration breeder-to proceed to the design phase as early as December,1951, the same year that its own Experimental Breeder number 1 (EBR-1) produced its first electricity- off"g , enough to light 4 light bulbs. ( By1955ithadarunawayexcursionandmeltdown$ The near catastrophe at Fermi in 1966 and the catalogue of mishaps both before segLL*- the accident and after did nothing to halt the AEC's obsessive interest in the breeder. It was not ooincidence that CRBR was born i= mediately after tiis AEC gave up on Fermi and refused to extend its license to operate in 1972. It had-already chosen Oak Ridge as the site of a second demonstration breeder. And m what better way to get funding than a Uranium shortage scare. However, the question of a Uranium shortage no longer applies as a reason for putting the CRBR on " fast track" that requires an emergency exemption frem rule 10 CFR 50,12. The projected level ofg nuclear power for the year 2000 dropped 68 % between 1972 and 1977,2 and has no doubt continued to drop in the face of conservation,which has already created excess capacity; and the excessive. capital costs of new plants, which is putting some utility companies in financial straits - which will, of course be passed on to the consumers. l l For these reasons, I urge you not to exempt the CRBR from rule 10 CFR 50.12. ) The exemption would have no validity in itself and would, almost certainly, be an inducement for further requests for exemptiens from other regulations by any company proposing to build a nuclear reactor. l

Garwin, IBM Fellow & Professor, Harvard University, states "Recent prototype large breeder reactor (PLBR) studies in the United States estimated the capital cost of a breeder reactor to be at least $600 million more than that of an LWR. Present uranium costs of some $30/lb would have to rise some
$130/lb before such a breeder could compete with the LWR, even if no economies were achieved in LWR operation. One economy in the present fuel cycle that is likely within the next ten years is a reduction in the cost of isotopa enrich-ment from the present $80-100/kg SWU to around $20/kg SWU." Clearly, the de-cline in electrical demand coupled with the rise in uranium supplies demon-strates the " emergency" proposed by the DOE to short-cut the CRBR licensing .

I unaerstand the LC_is considering an exemption for the Clinch liver reeder Meactor Pro 1ect which would allow grounc breaking ano site preparation on the project. 1 oppose the granting of such an exemption. My reasons for opposing the exemption are as follows:
- 1. There is no energy emergency that would call for an exemption ~
at this time. The energy usage of our country is declining. Yet the Breeders were planned when the projecticca were for increasin.T energy usage.
- 2. Congress is not strongly in favor of such a program. There is no clear voting mandate on this issue. In 1981 the amendment to cut the CHER Project lost & by Alq votes in the Senate and twenty votes in the house.
3 Any type of exemption which will allow ground breaking and site preparation (to the sum of $88 nillion dellars) on a project which has neither a construction permit or a limited work author 1-zation would surely not set well with the public. . Shat little public confidence the public has in any nuclear program wculd W s completely eroded. .
