APPENDIX A NOTICE OF VIOLATION W. Alva

License No. 47-18409-01 As a result of the inspection conducted on November 16, 1981, and in accordance with the Interim Enforcement Policy, 45 FR 66754 (October 7,1980), the following violations were identified.

i A.

License Condition 13 requires that licensed material be used in accordance with statements, representations and procedures contained in your applica-tion dated January 9,1981. One item of your application states you will i

have a dose calibrator at your facility.

Contrary to the above, on November 16, 1981', the day of the inspection, no dose calibrator was available at your facility in that it had been trans-ferred to another institution on November 10, 1981.

This is a Severity Level V Violation (Supplement VII).

l B.

License Condition 13 requires that licensed material be used in accordance j

with statements, representations and procedures contained in your applica-

t. ion dated January 9,1981. One procedure in your application requires that linearity checks of your dose calibrator be performed quarterly.

Contrary to the above, the linearity of your dose calibrator has not been checked in the past two years.

This is a Severity Level V Violation (Supplement VII).

C.

License Condition 13 requires that licensed material be used in accordance I

with statements, representations and procedures contained in your applica-tion dated January 9,1981. One statement in your application requires that.

a low level survey meter be available for use in your Nuclear Medicine Department.

Contrary to the above, it was determined that the low level survey meter was not available for use in your Nuclear Medicine Department in that it was i'

inoperable for approximately three months.

E.

License Condition 13 requires that licensed material be used in accordance with statements, representations and procedures contained in your applica-tion dated January 9, 1981. One procedure in your application requires the peformance of weekly radiation level surveys.

Contrary to the above, radiation level surveys had not been performed for approximately three consecutive months in 1981.

This is a Severity Level V Violation (Supplement VII).

F.

License Condition 13 requires that licensed material be used in accordance with statements, representations and procedures contained in your applica-tion dated January 9, 1981. One procedure in your application requires the performance of daily contamination surveys in your Nuclear Medicine Depart-ment.

Contrary to the above, contamination surveys were not performed from November 2 to November 13, 1981.

Thig is a Severity Level V Violation (Surplement VII).

Pursuant to the provisions of 10 CFR 2.201, you are hereby required to submit to this office within thirty days of the cate of this Notice, a written statement or explanation in reply, including: (1) admission or denial of the alleged viola-tions; (2) the reasons for the violations if admitted; (3) the corrective steps which have been taken and the results achieved; (4) corrective steps which will be taken to avoid further violations; and (5) the date when full compliance will be achieved. Consideration may be given to extending your response time for good cause shown.

Under the authority of Section 182 of the Atomic Energy Act of 1954, as amended, this response shall be submitted under oath or af firmelion.
