Enclosed is a copy of the recent judgment in People Agains t Nucle.u Energy v. NRC, No . 81-1131 ( D.C.Cir. Jan. 7, 1982),

The Power Authority of the State of New York cited the Commission's opinion in this case in its Memorandum of Law in 9;pport of Motion to Exclude Fear as an Issue in This Proceeding a t 8 -10 ( f iled De c . 2, 1981). The majority opinion of the Court of Appeals has not yet been released.

The Power Authority's argument that certain intervenors should be estopped from participating in this proceeding because they distributed literature with the intent of causing, or exacerbating psychological stress in the community remains unaf-fected. That conduct is also alleged by the Power Authority as an independent ground for the exclusion of psychological stress from this proceeding and, certainly for preventing the inter-venors who so conducted themselves from participating in any consideration of the issue. ,

If necessary, the Power Authority will provide an analysis of the opinion of the Court of Appeals and its relationship to the facts of record here, when the opinion is published.
