Gentlemen:

Licensee has supplied you with a memorandum of the j

Ohio National Guard dated December 29, 1981.

This memorandum demonstrates the necessity for granting Intervenors motion to expand O'Neil contention IID to include overflights by all planes, not just B-52 Air Force Bombers.

The memorandum makes clear that flights over and around the plant continue to be a problem and that Ohio National Guard planes have violated the self imposed "No Fly" area of the Ohio National Guard in the vicinity of the plant.

It also reveals that flights directly over the plant will continue.-

Contrary to the assertion by counsel for Licensee that the memorandum will GD I \\

l bar flights under 1500 feet, the memorandum refers to a

" ceiling" of 1500 feet in overflights.

Whatever the meaning of this statement, it seems clear that only a full exploration of the matter by a hearing can insure the safety of the public.
