Dear Mr. Cochran:

This is in further response to your letter dated March 14, 1980 in which you requested copies of all information pertaining to NFS Erwin from January 17, 1980 to date.

In nty letter to you, dated July 16, 1980, I identified as documents five and six, two reports as being subject to your request and informed you that they were undergoing a declassification review.

That review has now been completed.

Portions of those documents are being withheld in that they contain Restricted Data and National Security Information.

This information is being withheld from public disclosure pursuant to Exemptions (1) and (3) of the Freedom of Information Act (5 U.S.C. 552(b)(1) and (3)) and 10 CFR 9.5(a)(1) and (3) of the Conmission's regulations.

The non-exempt portions of the documents are enclosed.

Pursuant to 10 CFR 9.9 of the Commission's regulations, it has been determined that the information withheld is exempt from production or disclosure, and that its production or disclosure is contrary to the public interest. The persons responsible for this denial are the undersigned and Mr. Raymond J. Brady, Director, Division of Security.

This denial may be appealed to the Conmission's Executive Director for Operations within 30 days from the receipt of this letter. As provided in 10 CFR 9.11, any such appeal must be in writing, addressed to the Executive Director for Operations, U.S. Nuclear Regulatory Commission, Washington, D.C. 20555, and should clearly state on the envelope and in the letter that it is an " Appeal from an Initial FOIA Decision."

This completes NRC's action on your request.
