REGARJING DISCOVERY ACTIVITIES - NUMBER 4 This report is filed in accordance with the Licensing Board's Memo-randa and Orders dated October 3,1981 and November 5,1981, as modified I
by the on-the-record telephone conference call among the Board and the 1
parties on November 17, 1981.
A.
Discovery activities since report dated December 22, 1981:
1.
The Staff has received the Intervenor's answers, filed on December 22, 1981, in response to the Staff's interrogatories filed December 2,1981. On January 7,1982, Staff counsel sent a letter to Intervenor's counsel confirming a January 6,1982 telephone conserva-tion with an authorized representative of the Intervenor.
The con-versation was an attempt to resolve differences concerning discovery in direct discussions, and resulted in an agreement between the Staff and the Intervenor.
The letter was discussed in an on-the -record telephone conference held on January 11, 1982. During that telephone conference, the Board directed Intervenor to respond to the letter gngg w@t.

t other outstanding interrogatories to inform their propounders fully of whatever bases the Intervenor now considers important and upon which it intends to rely at a hearing by January 18, 1982 (Tr. at'889-90).
This afternoon, the Staff received a response from the Intervenor, while the Staff was preparing to file this report.
The Staff has not yet had the opportunity to review the documents cited as bases by the Intervenor in its response.
Accordingly, the Staff is unable to deter-mine at this time whether Intervenor's response complies with the agree-ment betweem the Staff and Intervenor described in the Staff's January 7, 1982 letter and the Board's direction at Tr. 889-90.
2.
The Staff has not received any discovery requests from the licensee or Intervenor.
B.
Plans for future discovery by the Staff:
The Staff will conduct future discovery in accordance with the Board's oral order of January 11,1982 (Tr. at 889-90).
