ON WHETHER COMMISSION SHOULD DEFER RESTART DECISION UNTIL ISSUANCE OF LICENSING BO7<D'S OPINION ON OPERATOR CHEATING INCIDENTS l
1 In its January 13, 1982 comment; on.whether the Commission should defer a restart decision until issuance of licensing board's opinion on operator chearing incidents, received by TMIA on January 16, 1982, the Staff insists that the reopened hearing on cheating is not a legal bar to the Commission's ruling on immediate effectiveness. This is despite the Staff's recognition that all management-related concerns have not been fully and finally resolved.
For the reasons already stated in TMIA's January 13, 1982 comments, TMIA maintains that there are significant legal and policy reasons which recluire the Commisssion to defer its decision.
In addition, however, we urge the Commission to consider one additional point. Since its inception, this Commission has recognized the TMI-l restart proceeding as extraordinarily unique.

Apart from all legal considerations and particularly in i
light of the strong evidence developed during the reopened proceedings of management incompetence and lack of integrity, as 1
well as the inadequacy of the training and testing process, a restart decision by the Commission now, even at 5% power, would be viewed as grossly unfair by those who live in this area.
r TMIA can discern no rational reason-legal, economic or otherwise-why the Commission need make this decision now. We 4
strongly urge the Commissioners to afford the residents in this area, who have already lived through the trauma and strain of the worst commercial nuclear accident in this nation's history as well as illegal exposure to, krypton, a minimal degree of a
