Dear Mr. Secretary:
This letter is to ensure that there is no misunderstanding as to the date upon which a response.is due from the State of Maine as provided for in a Memorandum and Order in the above matter as signed by Dr. Lazo and served on December 30, 1981.
In that Order, the State of Maine is provided " fifteen (15) days from the date of service of this Order, within which to file a response to objections to (its) amended contentions filed by licensee and NRC staff.'
In accordance with 10 CFR 2.710, the State understands that the date on which its responses must be served is Tuesday, January 19, 1982, calculated as follows:
l (1)
December 30 is not counted; see 10 CFR S 2.710; (2)
December 31 - January 14 count as the 15 days provided in the Order; and (3)
January 15 - 19 count as the five days added to the prescribed period because the Order was served by mail; see 10 CFR S 2.710.
Although we believe that the date on which our response must t
be served is January 19, 1982, to the extent that the Order of December 30, 1981 is interpreted by any of the parties so as to re-quire answers to be filed by January 14, 1982, we request that this letter be considereo a motion to enlarge the time in which to file our responses until January 19, 1982.
Although the Memorandum and Order indicate it was served on December 30, 1981, we did not receive it until January 5, 1982.

January 19, 1982 to file its responses in light of the licensee's position that it does not oppose such extension.
Although it is the State's position that its answers are i
not due until January 19, 1982, we believe that the basis for our position should be stated on the record.
In the event there is aray disagreement about our interpretation of the date of service, we request that our motion to enlarge the time for filing be granted.
