SUBJECT:
ANNUAL OMB CIRCULAR A-76, POLICIES FOR ACQUIRING COMMERCIAL OR INDUSTRIAL PRODUCTS AND SERVICES NEEDED BY THE GOVERNMENT, INVENTORY UPDATE The Office of Management and Budget (0MB) requires that all agencies in the Executive Branch perform an annual update of their inventories of commercial or industrial activities subject to 0MB Circular A-76.
In the past, each office within NRC has been required to provide a complete listing of every activity within the office and either identify the code that makes the activity exempt from the provisions of OMB Circular A-76 or provide a tentative date for the required OMB Circular A-76 review.
As a result of negotiations between my staff and OMB, the 1982 A-76 update will be markedly abbreviated.
Three key concessions have been negotiated.
There is no_ requirement tq: (1) recertify the functions performed by the in-house staff that were accepted as exempt in the 1981 update, (2) tepor_t._ Activities tha_t.have a_ duration _of_five years or less and (3) report any effort placed at the 00E National Laboratories.
The 1982 OMB Circular A-76 update will require the reporting of only the following items:
(a) _an_y staff effort that could be orocured in the private sector provided that it does not involve: (1) the discretionary application of government authority such as investigations, judicial functions, p&
management of programs requiring value judgments and selection of program priorities, (2) revenue disbursement or (3) technical analysis and evaluation and technology base manac MC5105 Attachment 5p.3 para 5(f)1-5(ementandmaintenance.(Ref.
f)3).
An example of a reportable effort would be a branch or section that has as its only function the translation of reports from foreign languages into English.

To comply with the OMB require tents, those offices that have activities subject to 0MB Circular A-76 will complete Attachments 2 and 3 of NRCMC 5105-1, June 29, 1979 as applicable.
Those offices that have no activities subject to OMB Circular A-76 must provide the CON with a negative response. All submissions are due to CON no later than January 27, 1982.
