As part of its Hotion for Summary Disposition of 0'Heill Contention II.D. Licensee furnished the Board and parties with copies of an internal memorandum concerning an overflight of the Big Rock Point Plant by planes of the Ohio Air flational Guard. The Staff has recently received a letter from Captain William P. Hickey, Jr., of the Gnio Air flational Guard relating j

to this matter.

l The Staff is furnishing a copy of Captain Hickey's letter to the Board for its information.

Copies are also being sent to all parties to the pro-cceding.

To:

1.

The present airspace definitions for the Wolverine Military Operating Area (M0A) inscribe a 5 nuatical mile "No Fly" zone below 5000ft around the town of Charlevoix, Michigan.

This "No Fly" area provided the Big Rock Point Nuelear Power Station with a 1 nautical mile buffer from military activites.

2.

It has been brought to our attention that military fighter type aircraft have been observed 1 nautical mile from the plant but reported as overflying it by plant personnel.

This occurrence has raised concern by both Nuclear Regulatory Commission and military officials and has precipitated redefinition of the military airspace boundaries.

3.

Effective immediately, an additional "No Fly" area will be established specifically around the Big Rock Point Nueclear Power Station.

This area will be 2 nautical miles in radius with a ceiling of 1500ft above ground level.

As mentioned, this will be in addition to the "No Fly" area around Charlevoix, MI.

This new area will be briefed to each aircrew prior to flying in the Wolverine :10A. Aircrews from other units will be briefed by this unit in accordance with established military procedures.
