By letter of January 6,1982 the Applicant requested a ruling on the Staff's un,:ontroverted motion for summary disposition of Contention 5 filed November 16, 1981, and supported by Applicant's response of December 11, 1981. The Staff supports the Applicant's request in light of the fact that

prefiled testimony must be served by the parties on February 8,1982 and, absent a ruling by the Board, at this time it is uncertain as to whether or i

not testimony concerning Contention 5 will be required.

In view of this I

uncertainty, the Staff respectfully requests a prc.mpt ruling by the Board on I
