In its Order dated November 30, 1981, as modified by its orders dated December 23, 1981, and January 11, 1982, the Commission invited the parties to the TMI-l restart proceeding (1) to comment by January 28, 1982, on whether the Licensing Board's partial initial decision of December 14, 1982, on de-sign issues, emergency planning and.s'eparasion of TMI Units 1 a'nd 2 should be made immediately effective and (2) to.ccmment by January 13, 1982, on whether the Comm'ission should defer its ,

immediate effectiveness decision until after the Licensing Board has issued its decision in the reopened hearing to consider the implications of.the cheating incident on the NRC's April, 1981 9 56 s ,3 i t!

The reopened hearing was concluded on December 10, 1982.2/ Under procedures established by the Board, the Board's decision will not be made until after (a) the parties have filed all proposed findings and reply findings, (b) the Special Master presiding over the reopened hearing has. issued his report to the Board, (c) comments by the parties on that report have been filed with the Board, and (d) the Board has considered and issued its decision. The Board estimated in its decision of December 14, 1981, that its decision on the reopened proceeding will not issue until March or April, 1982.

Licensee's position is that the Commission's deci-sion on restart should not await the Scard's decision relating to the cheating incident.

In considering this question some perspective on ,.

.the cheating incident and the reopened hearing is necessary.

It is.an acknowledged fact that two of the operator license candidates cheated on the NRC examination in April, 1981, and that both were promptly terminated by . Licensee. The Board did not suggest that the cheating by two operators was in it-self grounds ~ for reopening the hearing. The Board discerned in this incident, however, the possibility of impacts on other issues bearing on Licensee's management and technic.al capability and reopened the hearing on its own motion to con-sider these possible impacts.

The cheating incident and the Board's decision to -

reopen the hearing on the basis of the cheating incident do not. establish a presumption of inadequacy in Licensee's management and technical capability and are not in themselves a basis for continuing the suspension of TMI-l's operating authority. It is inconceivable to Licensee that.a similar

. episode and decision to hold a hearing at another operating

p ant would be considered by the 'Comm'ission as a basis for suspending an operating license. ,

Had the reopened hearing developed evidence of seri- ,

ous management incompetence or lack of integrity, such evidence might properly be taken into account by the Commission as grounds for deferring its decision on restart. The fact is -

that it did not.

The evidence clearly established that there was no management ccmplicity in any cheating episode; instead the evidence fully supported the thoroughness and responsible attitude with which management responded to the cheating inci-dent. The hearing also explored at length other operator irregularicies or allegations of irregularity in connection with both the NRC and Licensee operator examinations, but de- .

the absence of any Special Master's report. Unlike the Board, the Commission will have before it the views of all affected parties on the information developed in the reopened hearing and can decide whether that information raises concerns of such pro- .

portions as to justify continued suspension of the TMI-l license. .

The practical difficulty with the Board's recommend-ation is that its decision on the reopened hearing is not expected until March or April. Further time may be added for r,eceipt and consideration by the Commission of the parties' comments on that decision. The potential delay in returning

TMI-l to commercial operation is not justified by developments in the reopened hearing.
