Dear Sir:

On October 5, 1981, the Authority met with members of your j-staff to discuss the difficulties which we are experiencing in meeting the implementation dates of the various post TMI and other NRC requirements.

The fundamental problem in complying with j

the NRC mandated dates is the overwhelming number of backfit modifications required within a short period of time, coupled with the various activities normally associated with the operation l

of a nuclear facility.

Some of these modifications are akin to major construction projects necessitating extremely high engineering and craft manpower levels.

This situation has affected plant operation as follows:

significant increase in the activities per-formed during power operations, elongated outages, extended periods of employee overtime; large number of craft on site which reduces productivity and efficiency, participation of plant management and I

staff in modification related activities abating their attention to plant operations and deferred maintenance programs.

i To alleviate this condition, the Authority has developed an alternate schedule to meet the NRC requirements in a timely matter without jeopardizing safety.

The proposed schedule presented in Attachment I integrates the NRC requirements with plant improve-ment and maintenance activities.

The schedule has been prepared taking into consideration the following important factors:

Anticipated delivery of qualified material, equipment and/or components.

. ing design scope, unplanned outages, planning of refueling outage related activities and availability of qualified craft manpower.

These concerns may require adjustment of the schedule on a case by case basis.

N*. verthele ss, the Authority considers that the integrated schedule approach proposed herein will provide an optimum mechanism to identify these problem areas earlier and rcinimize their overall impact and allow the most efficient use of the NRC and Authority ' resources.

Manpower availability.

This includes engineering and technical personnel to perform the analyses and design modifications, and qualified craft labor.

In addition to the shortages of craft labor experienced industry wide, the FitzPatrick facility is adjacent to Nine Mile Point Unit 1 which is an operating plant faced with sim-ilar backfitting requirements, and Nine Mile Point Unit 2 currently under construction, which compounds this prob-lem.

3)

Work area conflict.

Certain large modifications which due to access limitation require additional time to complete.

Also, more than one modification required in the same plant vicinity causing similar access prob-lems.

4)

Limit of maximum number of craft labor and support personnel, e.g.,

security, radiation protection, qual-ity assurance, etc., on site which can be effectively managed and supervised by the Authority.

5)

Difficulties encountered with performing analytical work to support modifications e.g.,

Mark I Program.

6)

Conflicting NRC requirements associated with the same area but having different due dates, e.g.,

NUREG-0737 requirements have earlier implementation dates than Regulatory Guide 1.97, but the scope of the former are expanded by the latter.

However, in many cases the reg-ulatory requirements of Regulatory Guide 1.97 can not be met within the time frame of the TMI Requirements.

Refueling outage length and plant availability to re-duce the adverse economic burden on New York State con-sumers.

As a result, some NRC requirements are extended beyond the man-dated deadlines or commitments previously submitted by the Author-ity.

These items are identified in the schedule with an asterisk.

The estimated manpower level associated with this schedule is pre-

sented in Attachment II.

Based on the above, the Authority requests your approval of the attached schedule.

Upon receipt of your concurrence the Power Authority intends to maintain the schedule as a living doc-ument and integrate future NRC requirements and plant needs.

The Power Authority will make every possible effort to meet the pro-posed schedule.

However, the schedule is based on many uncertain-ties such as equipment procurement problems, undefined or chang-
