LOUISIANA POWER AND LIGHT COMPA'tf Docket No. 50-382 (Waterford Steam Electric Station, Unit 3)

NRC STAFF'S RESPONSE TO APPLICANT'S MOTION FOR ESTABLISHING HEARING SCHEDULE On December 23, 1981, Applicant Louisiana Power & Light Company

(" Applicant") filed its " Motion for Establishing Hearing Schedule"

(" Motion"). Therein, Applicant proposed that a hearing be commenced on March 23, 1982, with written testimony to be prefiled by March 9, 1982. The Applicant reported that counsel for the Joint Intervenors concurred in the Motion, and that counsel for the NRC Staff (" Staff")

was not then able to state the Staff's position.

Counsel for the Staff has now consulted with members of the Staff and other persons whose testimony and presence will be required at any hearing in this proceeding.

In light of these consultations, the Staff believes that it will be able to comply with the schedule proposed by the Applicant.

The Staff wishes to note that its ability to comply with this schedule depends, in part, on the timely completion of findings and testimony by the Federal Emergency Mansgement Agency (FEMA); FEMA's findings, upon which its testimony will be based, are due to be issued on January 20, 1982. While the Staff presently believes that FEMA DESIGNATED ORIGINAL pjqgeaanyg c=ma=- +

D will be able to issue its findings by that date and that the proposed schedule may be met, the Staff will inform the Licensing Board and the parties of any developments which impact upon this conclusion.
