i; In its September 9, 1981, Memorandum and' Order the Ato Safety & Licensing Board limited the scope of Intervenor Sunflower Alliance, et al., contention on quality assurance to the stop work order of February 1978 and " steps taken to remedy that [ sic]

deficiencies that led to that order, and residual deficiencies related thereto."

However, recent events have demonstrated that the quality assurance deficiencies and resultant unsafe construction are continuing at the Perry site:

1.

November 20, 1981 - Newport News Industrial Corp. was ordered to stop work when a -719-foot defective weld in the Unit 1 suppressibn pool was deliberately concealed.

A foreman and a supervisor had ordered two welders to cover the weld with a long steel plate.

After doing so, the workers then reported the' incident to officials.

The foreman was fired and the supervisor

was suspended indefinitely.

2.

November 23, 1981 - L. K. Comstock & Co., Inc., was ordered to.stop work when NRC inspectors discovered Comstock employees improperly pulling a 100-foot 480-volt electrical cable through a conduit in the emergency service water pump house.

The above items are the most recent violations, but they are by no means the only violations occurring subsequent to the 1978 stop work order.

Most of 'these items were filed with the Board at the Special Pre-hearing Conference; however, the Board chose not to accept any further particularization of this contention due to a procedural

technicality (Special Pre-hearing Conference Memorandum and Order at p. 58), and apparently this ir-the root of the limitation imposed in the September 9, 1981, Memorandum and Order.

We would hope that the Board has retained the spirit of its October 2, 1981, Order on EMP/ATWS, namely, that this proceeding is still young and, therefore, technicalities should not be used to exclude issues (Oct. 2 Order at p. 2).

The recent events at Perry are indicative of the serious nature of QA and construction deficiencies, and said deficiencies could well result in conditions inimical to the health and safety of the public.

Issues of such vital importance to the health and safety of your Intervenors should especially not be vitiated by technicalities.

The above items clearly indicate the continuing ' nature of QA deficiencies at the Perry site; these problems are not just related to improper paperwork and organizational procedures (See SPC Memorandum and Order at p. 57), but rather are manifested in physical defects at the plant.

In further support of the amending of this contention are the recent public remarks made by NRC Chairman, Nunzio J.

Palladino, Chairman Palladino is-quoted as saying:

"There have been lapses of many kinds--in design analyses resulting in built-in design errors, in poor construction practices, in falsified documents, in harassment of quality control personnel and in inadequate training of reactor operators."

Many cf these deficiencies are demonstrated in this Motion.

This Board has noted its primary responsibility in resolving disputes regarding plant safety (SPC, Pg. 59-60).

I-documented'-the Quality Assurance Deficiencies b'y submitting the ins,pection reports immediately after the Special Pre-hearing conference.

Nothing in the SPC demonstrates any reliance solely on the February 1978 Stop Work Order.

Sunflower asserts that serious deficiencies in Applicant's Quality Assurance Program occurred after the February 1978 stop, work order.

We.have done this when we originally filed.

The record demonstrates the truthfulness of the assertion.'

Since this Board must assure itself that the plant is built according to appropriate NRC standards, it must broaden the contention to support any finding the Board may make.

Perry's OA record is not satisfactory.

This contention must be expanded to cover all periods of construction as Sunflower originally alleged.

Even if the Board wishes to treat this as a late filing, there is adequate reason to permit the expanded contention.

See 10 CFR 2.714 ( A) (1).

Sunflower asserts that this contention has not been filed late but even if the Board treats it as such good cause exists.

One the most recent violations is in fact recent.

Secondly,'the bulk of the other violations were supported when Sunflower filed the inspection reports.

There is not uther mechanism available to protect Sunflower's interest.

This licensing proceeding is supposed to demonstrate to the public that the PNPP was built safely and that its operation will not harm the public.

The most recent violations at Perry lessen the pu'lic's confidence that the plant is being built b

safely.

This Board must certify that the plant is built safely.

There is no other place to determine this issue except in this proceeding.

Clearly, the work performed in this Motion demonstrating what violations are still not cleared will help the Board in developing a sound record.

Intervenor seeks to build a sound record.

The development of the QA issue will be immensely important in developing the record.

To the best of Sunflower'r knowledge, no other intervenor has filed or will file on this issue.

Finally, the expansion of this contention will not delay these proceedings.

The proceedings are young.

The issue is critical.

The public has a right to be assured by this Board that the plant is safe.

This is the overriding consideration.

WHEREFORE, your Applicant prays that the contentions be

expanded to cover any violation of & QA/QC standard at PNPP whenever it occurred.
