ENVIRONMENT OF SOUTHEASTERN NEW { annaresum HAMPSHIRE PURSUANT TO 10 C.F.R.  % enung, S 2.714(a)(3)

  • 4 f to to
1. On November 10, 1981, the Society for the Protection of the Environment of Southeastern New Hampshire (the Society) filed, in letter form, a petition to intervene in the above-entitled

. matter.

2. Pursuant to 10 CFR $ 2.714(c), the Applicants answered this petition, advocating its denial for two separate reasons:

(1) the failure of the petition to set out names and addresses of any members who wish to be represented by the Society and have the necessary interest to confer standing, Answer, 1 1; and (2) the fact that the only issue which the Society wishes to raise (the routing of transmission lines) is not open to 8201150227 020107 PDR ADOCK 05000443 G PDR p0 3 )

litigation at the operating license stage, Answer, 1 2.

3 By the motion at bar the Society seeks to overcome the first of the above-described objections by incorporating in the Petition the affidavits of some 17 individual members.

4. The Applicants have no objection to the allowance of the motion to amend, and concede that allowance of the motion would overcome the Applicants' first above-described objection to the petition. However, the second objection (the inappropri-ateness of the issue-raised) is still valid.

WHEREFORE: The Applicants say that the motion to amend should be allowed and that the petition, as then amended, should be denied.
