NRC Docket Nos. 50-448 and 50-449 This will acknowledge receipt of your letter dated December 14, 1981, notifying Potomac Electric Power Company (PEPCO) that under 10 CFR Part 170 the Nuclear Regulatory Commission has assessed review costs to PEPC0 for review of the PEPCO. construction permit application for Douglas Point 1 and 2. You indicate that the review costs are

$1,011,966.00, less the application fee formerly paid of $70,000.00, leaving a balance due of $941,966.00.

PEPC0 is one of several utilities that has taken exception to NRC's proposed collection actions. PEPC0 disputes the NRC's authority to collect these charges on Douglas Point. Related charges are in litigation in the First Circuit and it is hoped that the Court decision in that case will provide guidance that can be applied in determining the validity of the Douglas Point charges. Pending the outcome of the litigation, PEPC0 respectfully declines to pay the assessed review charges.
