Isotope Measurements Laboratories, Inc., Northbrook, Illinois, i
(Licensee) is the holder of NRC License No. 12-13568-01 which authorizes the licensee to receive, store and deliver packaged radiopharmaceuticals to specifically licensed recipients, in accordance with the conditions specified therein.
Pursuant to Section 234 of the Atomic Energy Act of 1954, as l
l amended (42 U.S.C. 2282), and 10 CFR 2.205 of the Commission's I

regulations, on May 28, 1981, the Director of the Office of Inspection and E-forcement served on the licensee a Notice of Violation and Proposed Imposition of Civil Penalty, which alleged that violations of Commission requir ements had occurred and set forth civil penalties to be assessed for the violations. The violations were identified as a result of an investigation of the licensee's activities conducted from June l
i 1980 through January 1981, which found that the licensee was receiving and distributing radiopharmaceuticals without specific authorization.

/[6 After consideration of the licensee's June 24, 1981 response, the Director issued an Order Imposing a Civil Penalty on October 22,1981 in ADD 5 the total amount of $5700.00.

Pursuant to the Atomic Energy Act of 1954, as amended, and regulations in Title 10, Code of Federal Regulations, Part 2, notice is hereby given that a hearing will be held before the Honorable Ivan W.
Smith, Administrative Law Judge, at a time to be set by the Administrative Law Judge. The issues to be considered and decided shall be:
(a) Whether the licensee was in noncompliance with the Commission's requirements as set forth in the May 28, 1981 Notice of Violation and Proposed Imposition of Civil Penalty; (b) Whether the October 22, 1981 Order Imposing a Civil Penalty should be sustained.
4 A prehearing conference will be held by the Administrative Law Judge at a date and place to be set by him to consider pertinent matters in accordance with the Commission's Rules of Practice.
The date and place of hearing will be set at or after the prehearing conference and notice in the Federal Register.
Pursuant to 10 CFR 2.705, an answer to this Notice may be filed by the licensee not later than twenty days from the date of publication of this Notice in the Federal Register.
Required papers shall be filed by mail or telegram addressed to the Secretary of the Commission, U.S. Nuclear Regulatory Commission, Washington, DC, 20555, Attention: Chief, Docketing and Service Branch, or by delivery to the Commission's Public Document Room 1717 H Street, NW.,
Washington, DC.
Pending further order of the Administrative 1:w Judge, parties are required to file, pursuant to the provisions of 10 CFR 2.708, an

original and two (2) copies of each document with the Commission.
l Pursuant to 10 CFP. 2.785, the Commission authorizes an Atomic Safety and Licensing Appeal Board to exercise the authority and perform the review functions which would otherwise be exercised and performed by the Commission.
The Appeal Board will be designated pursuant to 10 CFR 2.787, and notice as to membership will be published in the Federal l
