Licensee's counsel until well after the close of business on i
January 4), TMIA requests an extension of time for filing comments with the Commission on whether the Licensing Board's Partial Initial Decision of December 14, 1981, should be made immediately effective and on whether to defer a decision on j
restart until the Licensing Board issues its decision in the 1
reopened proceeding on cheating issues.
The Commission has i
already on its own motion extended the comment period to January 13, 1982.
TMIA seeks a further extension of the time i
for filing comments to February 15, 1982.
For the reasons 3
j set for'th below, Licensee opposes TMIA's request.
At the outset the Commission should note that TMIA
%O3 played no part during the restart hearing in any of the areas 5
covered by the Licensing Board's December 14 decision.

Its only participation has been on management issues, including its participation in the hearing reopened sua sponte by the Licensing Board on the cheating incidents.
Thus TMIA has no legitimate basis for s
i concerning itself with extension of the comment period except as its comments may relate to the question of.the Commission's

making a restart decision prior to the Board's decision on the reopened hearing.
TMIA has known since the Commission's Order i
i of November 30, 1981, that its comments on the latter question would be required.
TMIA's excuses for extending the comment period do f
not bear scrutiny.
Its rirst excuse is the January 13, 1982.
l deadline for filing comments on the presentation by Victor Stello to the Commission on December 21, 1981, on information flow

during the TMI-2 accident.
It is highly doubtful that TMIA can make any contribution to the Commission's already extensive deliberations on this subject.
It made no contribution during the restart hearing.
In any event TMIA's motion fails in any way to indicate the nature of the comments which TMIA has under consideration or to indicate in any way why preparation of the comments would be time-consuming.
1/ TMIA withdrew its only contentions relating to plant design and separation and had no contentions on emergency planning.

e Second, TMIA points to its involvement in the prepar-ation of findings, due January 15, 1982, for the reopened hearing on cheating incidents.
As pointed out in Licensee's response to the Aamodt's motion for extension of time, the Special Master allowed some 35 days for the preparation of such findings after the close of the reopened hearing.
From its participation in the reopened hearing and its work on pro-posed findings, TMIA should be in a position quickly to formu-late its comments on whether the Commission's restart decision should await the Licensing Board's decision on the reopened hearing--the only comments as to which TMIA has a legitimate basis for concern.
TMIA's adoption of UCS' thesis, that delay in the comment period would not in any way delay the date on which the potential restart of TMI-l would occur, is addressed in Licensee's 2eply to UCS' request for extension of the comment period.
For tne above reasons, Licensee requests that the' Commission deny TMIA's request for extension of the comment period.
