t APPENDIX A NOTICE OF VIOLATION United Nuclear Corporation Docket No.70-371 UNC-Naval Products License No. SNM-368 As a; result of the inspection conducted on November 16-19, 1981, and in accordance with the Interim Enforcement Policy, 45 FR 66754 (October 7, 1980), the following violations were identified.

'A.

Condition 10 of your facility license which incorporates Section 2.5,

" Operation Control," of your approved license application dated March 28, 1977, requires, in part, in Section 2.5.1, " General," that NPD Management shall require supervis'on at all levels to assure themselves that suitable control measures relative to r.uclear criticality safety or radiological safety shall be prescribed.

Contrary to the above, on November 17-18, 1981, NPD Management did not require supervision to assure that suitable controls relative to nuclear criticality safety were prescribed and specified on posted authorization forms, for the storage of residuals containing SNM in a moderated storage array located-in the Filler Fabrication No. 2 Q.C.

area; for the spacing, storage and SNM contents of unsafe geometry containers in the Chemistry Laboratory; for the storage of SNM containing waste drums and containers in the two " dog pens" and the Drum-Storage trailers, for the storage of drums containing SNM in the Health Physics basement; and, for maintaining the quantity of SNM in the Metallography Laboratory Sample Inspection-Room.

In addition, ongoing suitable radiological safety controls were not prescribed for the outside storage of waste drums in the " dog pens" which are not protected from adverse weather conditions.

This is a Severity Level IV violation (Supplement V10.1.)

B.

Condition 10 of your facility license which incorporates Section 2.6

" Nuclear and Industrial Safety Controls", of your approved license application dated March 28, 1977, requires, i.i part, in Section 2.6, that Operating Supervision must assure that nuclear. criticality safety control measures are followed as defined by or approved by NIS.

Section 2.6;1.2 " Authorizations" states, in oart, that authorizations shall specify the applicable controls and the conditions of approval and that all SNM processing, handling and storage areas shall-be posted with the authorized criticality safety limits.

Contrary to the above, on Noventber 17-18, 1981, operating supervision did not assure that nuclear criticality safety control. measures as defined by or approved by NIS were followed in that the posted limits in the Metallography Laboratory Sample Inspection Room and in Dog Pen No. 2 were exceeded. was 350 grams U-235 (369.5 grams were present) and for each drum in Dog Pen No. 2 was 50 grams U-235 (drum 10-80 contained 50.7 grams and drum 1-81 contained 50.6 grams).

This is a Severity Level IV violation.

C.

Condition 10 of your facility license which incorporates Section 2.5,

" Operation Control," of your approved license application dated March 28, 1977, requires, in part, in Section 2.5.1, " General," that NPD Management-shall require supervision at all levels to assure themselves that all pertinent regulations, controls, or procedures relative to nuclear criticality safety are followed by supervision and all operating personnel.

The United Nuclear Corporation Naval Products Division " Material Handling Rules Manual" dated August 3,1973, under " Criticality Control Rules" in item 3, states, in part, that designated fuel cart parks will be defined.

Item 5 states, in part, that fuel carts in an aisle must be attended at all times.

Contrary to the above, on November 18, 1981, supervision did not assure themselves that all pertinent procedures relative to nuclear criticality safety were followed by supervision and all operating personnel in that one fuel cart containing fuel bearing components was not parked in a defined, designated, fuel cart park location, but.was in an aisle between fuel zones in the Dye Penetrant test area of Building M and was not attended.

This is a Severity Level VI violation.

(Supplement V1.F.)

Pursuant to the provisions of 10 CFR 2.201, United Nuclear Corporation, is hereby required to submit to this office within thirty days of the date of this Notice, a written statement or explanation in reply, including:

(1) the corrective steps which have been taken and the results achieved; (20 corrective steps which will be taken to avoid further violations; and (3) the date when full compliance will be achieved. Under the authority of Section 182 of the Atomic Energy Act of 1954, as amended, this response shall be submitted under oath or affirmation. Where good cause is shown, consideration will be given to extending your response time.
