Dear Mr. Palladino:
By filing dated November 19, 1981, we appealed to the full C n. mission f rom an initial decision of th'e Atomic Safety and Licensing Board in Dockets 50-266 and 50 -301, relating to the Licensee's proposed " sleeving" program at the Point Beach Nuclear Plant.
By Notice dated December 1,1981, we were informed that an Atomic Safety and Licensing Appeal Panel had been formed to hear this appeal.
It is our understanding that the appeal is to t$e full Commission, not to an Appeals Panel.
- Moreover, there is a pcessing time element in this case which would make the time c.nsumed by an additional layer of appeal moot any effective relief.
Specifically, the Licensee has apparently returned Unit 1 to service and is now operating in a manner which the appeal contends is unsafe.
Therefore, this is to respectfully request that the Commission return the appeal.to its jurisdiction f rom the Appeal Panel.
