s Appendix NOTICE OF VIOLATION
.Magna Chek License No. 21-19111-01 As a result Of the inspection conducted on December 8,1981, and in accord-ance with the Interim Enforcement Policy, 45 FR 66754 (October 7, 1980),.the following violations were identified:
1.
' License Condition No. 19 requires that licensed material be possessed and used in accordance with statements, representations, and procedures contained in application dated July 18, 1979.' The Administrative Manual that accompanies that application states.on page 25 that the Radiation Safety Officer will conduct unannounced on-the-job inspections at inter-vals not to exceed three months.
Contrary to the above referenced requirement, quarterly Jobsite Audits
- by your. Radiation Safety Officer have not been performed during the past two quarters.
This is a Severity! Level V violation (Supplement VII).

10 CFR 34.43(c) requires that a. record of the survey required'by 10 CFR 34.43(b) be maintained for two years wuen the survey is the last survey' prior to locking the exposure device and'ending direct surveillance of the operation.
Contrary to this requirement, as,of the day of the inspection, December 8, 1981, you have failed to maintain records of the last-survey of your radiographic exposure devices prior to locking the
. device and ending direct surveillance of the operation.
This is a Severity Level VI violation (Supplement VII).

10 CFR 20.407(b) requires that you submit to the Commission within the first' quarter of each calendar year, a report of exposures recorded for individuals under your licensed program for the preceding calendar year.
Contrary to this requirement, as of the date of the inspection, December 8, 1981, you had not submitted the required report for calendar year 1980.
This is a Severity Level VI violation (Supplement IV).
Pursuant to the provisions of 10 CFR 2.201, you are required to submit to this office'within thirty days of the date of this Notice a written state-ment or explanation in reply, including for each item'of noncompliance:

Appendix (1) corrective action taken and the results achieved; (2) corrective action to be taken to avoid further noncompliance; and (3) the date when full com-pliance will be achieved. Under the authority of Section 182 of the Atomic Energy Act of 1954, as amended, this response shall be submitted under oath or affirmation. Consideration may be given to extending your response time for good cause shown.
