SECY-81-640 - Final Amendments to 10 CFR Parts 71 and 73 for Advance Notification to Governors of Transportation of Nuclear Waste Including Spent Fuel The Commission by a vote of 4-0 (Commissioner Roberts abstaining) approved publication of amendments to 10 CFR Parts 71 and 73 in final form which provide for advance notification to governors of transportation of nuclear waste including spent fuel.
The Commission requested that:
(1) the amendments (Enclosures A and B of the staff paper) be published in the Federal Register, and that the effective date be 180 days after publication, as stated in Recommendation D of the staff paper; (NMSS) (SECY SUSPENSE:

on how, when, and where the staff will negotiate with the Agreement States to assure compatibility of the Agreement State licensee requirements with the NRC regulation.

II.
SECY-81-637 - Proposed Amendment to 10 CFR 550.54(r) - Modi-Fication of Requirements for Submittal of Emergency Plans by Research and Test Reactor Licensees The Commission approved publication in the Federal Register of a proposed vote that would amend the dates and associated power levels for submittal of emergency plans by certain re-search and test reactor licensees.
The Chairman, Commissioners Roberts and Ahearne approved the rule as modified by Commissioner Ahearne.
Commissioner Gilinsky has approved in part; he does not approve the change in power level threshold from 500 KW to 2 MW, nor the date change as suggested by Commissioner Ahearne.
Commissioner Bradford approved; he agrees in part with Commissioner Ahearne's changes but he also would desire to include reactors from 500 KW to 2 MW and would agree with the date change if there were a firm outer limit to potential delay.
The Commission requested that:
