The Director of the Federal Registe r has identified a need to clarify the regula-tory status of Regulatory Guide 8.15, " Acceptable Programs for Respiratory Pro-I tection."
Regulatory Guide 8.15, by virtue of its incorporation by reference into paragraph 20.103(c) of 10 CFR Part 20, " Standards for Protection Against Radiation," has the same status as a regulation for those licensees who, in th.e determination of the radioactive material intake for occupationally exposed individuals, choose to make allowance for the protection afforded by respiratory protection devices.
Therefore, for these licensees this notice sunersedes, for the attached Regula-i tory Guide 8.15, the language at the bottom of the first page which states that regu-latory guides are not substitutes for regulations and compliance with them is not required.

We have completed the review of your preliminary list of materials you wish to have reapproved for incorporation by reference.
The following materials are presently on file at the Office of the Federal Register:
ASME Boiler and Pressure Vessle Code,Section III, Division 1, Articles NCA and NB, 1977 edition with S77, W77, and S78 addenda ASA B31.1, 1955 edition USAS B31.1.0, 1967 edition with 1971 addendum USAS B31.7, 1969 edition with 1971 addendum ASTM E-185-73 and E-185-79 IAEA'INFRCIRC/225/Rev.1 All other materials you wish incorporated must be filed with the Office of the Federal Fegister along with your formal request.
The first three items on your preliminary list cannot be approved for incorporation by reference. The first two are personnel manuals. We generally will not approve personnel manuals because there is no need to incorporate them by reference.
Persons affected by the incorporating regualtion are already bound to comply with the manuals without giving them the status of regulations by incorporating them by reference.

The third item is a Regulatory Guide. This sould not be incorporated by reference because on the first page of the Guide it says that USNRC Fegulatory Guides "are not substitutes for regulations and compliance with them is not required." It does not seem right to have a document which on it,s face purports to be nonregu/o, tory but which is elevated to -
regulatory status by incorporating it by reference in a regulation.
