The reference letter informed NRC of a delay in submittal of the subject report concerning the failure of Bergen Paterson Size 6 and 15 sway strut assemblies to provide the cone-of-movement required by design specifica-tions. The reference letter further indicated that tests would be per-formed simulating worst case installation in order to assess the safety significance of the reported failures and that a final report on this matter would be available for NRC review in early December.

The purpose of this letter is to advise NRC that the tests and related analyses indicated in our Nov. 4th letter have been completed and the results examined by Bergen Paterson, Bechtel and SNUPPS. On the basis of load tests performed, it is concluded that the sway strut assemblies installed with no cone-of-movement would not, if left uncorrected, result in a significant safety problem as defined under 10CF?50.55(e) criteria.

These tests and studies further indicate that the snubber would carry the maximum design load and would not restrict movement of the associated piping to a level that could produce a f ailure in the piping system. On the basis of these tests, the Oct. 9th telecon report that these failures represent a reportable deficiency as defined in 10CFR50.55(e) is hereby withdrawn. Data supporting the basis for our conclusion and actions in this matter is available for NRC review. It should be further noted that these f ailures, although not considered to be a reportable Signifi-cant Deficiency, are being processed in accordance with existing 8112290376 811214 OEC Q 1 jggj q#
