Pursuant to a phone call from the Appeal Board to UCS counsel, UCS has contacted the parties regarding their positions on the motion, and reports to the Appeal Board as follows.

was unable to contact Intervenors Chesapeake Energy Alliance -(CEA) and Marvin I. Lewis.

The NRC Staff agrees to the motion, and will' file written confirmation of this-with the Appeal Board.

Licensee agrees to

an extension to 10 days following the filing of. replies to parties' submissions to the Commission on the question of immediate effectiveness of the Atomic Safety and Licensing Board's Partial Initial Decision.
