POWER AUTHORITY'S MOTION TO STRIKE AFFIDAVIT OF LORNA SALZMAN AND AMENDMENT OF PETITION TO INTERVENE IN ABOVE PROCEEDINGS The Power Authority of the State of New York (Authority) moves this Atomic Safety and Licensing Board to strike the Af fidavit of Lorna Salzman and Amendment of Petition to Intervene in Above Proceedings (Salzman Af fidavit) filed by the Friends of the Earth, Inc. (FOE). As the certificate of service demonstrates (Exhibit A), the Salzman Affidavit has not been served on the Authcrity nor its counsel, despite the fact that their nanes and addresses are set forth on the of ficial service list of the Nuclear Regulatory Commission (Commission) for this proceeding. The requirement of service 8112290080 811221 PDR ADOCK 05000247 O PDR

of documents is mandatory. 10 C.F.R. SS 2.701(b); 2.712(b);
