%I]IM As you know, the Comission has extended the time within which it may review the June 26, 1981 decision under 10 CFR 2.206 (DD-81-10), which denied Save the Valley's petition to suspend resumption of construction on the !!arble Hill project. The Comission has asked that I examine whether the assurance achievable from the test and evaluation program at l'arble Hill meets NRC criteria in light of Save the Valley's July Addendum to its petition and the Office of Policy Evaluation's memorandum concerning this subject.

I have also considered your filings of August 5 and t'ovember 4,1981 to the Commission and the licensee's letter of November 2,1981 in conducting my reexamination.

For the reasons set forth in the enclosed " Supplemental Deci::fon under 10 CFR 2.206," I have reaffimed the decision to permit resumption of safety-related concrete work at Marble Hill. Although Dr. Cassaro, Save the Valley's consultant, raised a valid point regarding a defect in the statistical model for the Sart,ent & L. undy sampling program, I do not believe that the defect warrants suspension of construction or the initiation of a new sampling program (particularly since the testing program conducted identified zero defects) in light of all information known with respect to the quality of concrete in the project.

Copies of my supplemental decision will be forwarded to the Commission for its review in accordance with 10 CFR 2.206(c). Copte3 will also be placed in the Commission's public document rooms in Washington, DC, and in Madison, Indiana.
