NRC STAFF RESPONSE TO POWER AUTHORITY'S MOTION TO EXCLUDE FEAR OF NUCLEAR POWER AS AN ISSUE TO THIS PROCEEDING On December 1, 1981 the Power Authority of the State of New York (Authority) filed a document entitled " Power Authority's Motion to Exclude Fear of Nuclear Power as an Issue in this Proceeding" (Motion) with an attached Memorandum of law (Memorandum).
In this motion the Authority requests this Board to exclude from this proceeding the issue of fear of nuclear power. Motion at 1.
The futhority in the Memorandum attached to the Motion asserts that prospective intervenors NYPIRG, USC, and Parents have either raised in their petitions for leave to intervene the issue of fear or that the issues raised by the petitioners are broad enough Lto encompass the issue of fear. Memorandum at 1 and 2 note 1.

to intervene.
In fact, this Board has established a schedule for such answers. The Board at.the December ?, 1981 prehearing conference directet that answers to contentions raised by prospective intervenors be filed by 4
December 31, 1981. Tr. 153.
Thus, the Staff views the instant request as premature, and 4
accordingly urges this Board to' deny it.
