November 5, 1981, letter from J. G. Keppler to Cordell Reed.

Dear Mr. Keppler:

Reference (a) contained the results of an inspection conducted by Mr. D. Skov of the NRC Region V office on August 24, 1981, of a shipm nt of radioactive waste from Zion Station on its arrival at the Ri;hland waste burial site.

During tha t inspection, certain activities appeared to be in noncompliance with NRC f

requirements.

Attachment A to this letter contains Commonwealth Edison's response to the Notice of Violation.

To the best of my knowledge and belief the statements contained in the attachment are true and correct.

In scme respects these statements are not based on my personal knowledge but upon information furnished by other Commonwealth Edison employees.

Such information has been reviewed in accordance with Company practice and I believe it to be reliable.

<a ATTACHMENT A Response to Notice of Violation Violation:

10 CFR 71.5 prohibits transport of any licensed material outside the confines of the plant or other place of use or delivery of licensed materials to a carrier for transport unless the licen-see complies with applicable regulations of the Department of Transportation in 49 CFR Parts 170-189.

49 CFR 173.392(c)(1) requires that materials be packaged in strong, tight packages so that there will be no leakage of radioactive material under conditions normally incident to transport.

Contrary to the above, metal bin number 213 in a shipment of LSA waste from the Zion Nuclear Power Station leaked radioactive material.

Corrective Action Taken and Results Achieved Commonwealth Edison personnel were dispatched to the U.S.

Ecology waste disposal site at Richland to assess the LSA waste shipment.

A sample was taken of the leakage from metal bin number 213.

The sample result showed that the leakage was of very low activity, with the total leakage less than two pints.

The structural integrity of the metal bin was evaluated and determined to be acceptable.

The bin was then subsequently buried.

Corrective Action to be Taken to Avoid Further Noncompliance Following the incident, significant work has been done to improve our procedures and administrative controls to prevent a recurrence.

The main emphasis is in more effective contiol over the materials being loaded into the bin.

A loading for shipment is now being carried out as a continuous operation; i.e. once the loading starts, it will continue until the operation is completed and the bin covered and sealed.

In addition, management personnel are now presently directing this operation.

Whether,the weld failed during loading or the defect was there when the bin was received from the manufacturer cannot be easily determined.

We have spoken tua the manufacturer i

requesting that they also assess the need for improving their quality control procedures. :At our end, every-bin will be-visually inspected just prior to loading for shipment.

This inspection will be conducted by our Quality Control Department, which will make a determination of the struct~ ural integrity 'of the bin.

Furthermore,.every bin presently-loaded and stored at Zion is being reloaded in.QC-approved bins.

After'the bin is loaded and sealed,_ QCL wil1~ be present_ during placement of the

- container onto the truck to ensure the container remains intact.

The seriousness of this incident and the procedure changes involved have been discussed-with all the Zion personnel 1

-involved in radioactive material shipments.

Date When Full Compliance Will Be Met i

The licensee is in full compliance at the present time.
