Pursuant to 10 C.F.R. 9 2.749 of the Commission's Rules of Practice,
'. the Staff hereby moves the Atomic Safety and Licensing Board (Board) for summary disposition of Dr. David B. Fankhauser's contention 2(b),(c),
(e),(f) and (g) on the grounds that there is no material issue of fact in dispute which could be heard at an evidentiary hearing regarding the cited contention and that, as a matter of law, the Staff is entitled to such summary disposition.
The Staff moves, in the alternative, that if the Board denies the Staff's motion in its entirety, the Board specify which material facts remain in dispute.
