Dear Judge Milhollin and Members of the Atomic Safety and Licensing Board:
This letter will confirm Licensee's proposal for. dealing with l
documents, previously distributed by the NRC Staff on December 8, 1981,
.to.the Special Master, the. Board, and parties to the reopenc', hearing on cheating incidents, concerning questions on the October NRC RO written and oral examinations relating to throttling or termination of HPI.
The Licensee's proposal, as exclained in the conference call on Monday, December 14, 1981, and previously discussed with counsel for the NRC Staff, the Commonwealth of' Pennsylvania an1 UCS, has been modified in accordance with that conference call to provide that the documents listed below may be received by the Special. 1.
The documents previously distributed to the Board, Special Master and parties to the reopened hearing will be distributed to all parties to the proceeding who have not previously received the same.
Designation of individual examinees will be by the letter system adopted in the reopened hearing.
These documents may be received

in evidence in the reopened hearing in the discretion of the Special Master and may be used by the Board in considering whether to reopen the record on any other issues.

The NRC Staff will distribute to the Special Master, the Board, and all parties copies of the NRC answer key (including any revisions) to the HPI question and answers of other examinees to the question: Licensee will distribute to the same persons Licensee's relevant plant emergency procedures.
These documents will be put in evidence in the reopened hearing if the Special Master decides to put in evidence the HPI answers previously distributed in the reopened proceeding and will be taken into account by the Board in considering whether to reopen the record on any other issues.
The documents will be hand delivered by the Staff and Licensee to the Board, the NRC Staff, Licensee, UCS and Sholly not later than Thursday, December 17, 1981.
They will be sent by express mail,or comparable delivery service, to the Special Master, the Commonwealth of Pennsylvania, TMIA, and the Aamodts, and by regular mail to cther parties, by the rame date.

On or befo;e December 24, 1981, any party may file with the Special Master and the Board comments on this proposal, on the significance of previously distributed answers to the HPI question and on the relevance of such answers to the reopened hearing or to any other issues in the proceeding.
Such comments may include a requist by any party that the record of the hearing on non-checting issues be reopened for receipt in evidence of the above listed documents and/or that witnesses be called to address

Such comments shall be hand delivered to the Board, the NRC Staff, l

On or before December 30, 1981, any party may respond to any comments filed in accordance with the preceding paragraph.
Such comments shall be hand delivered to'the Board, the NRC Staff, Licensee, UCS and Sholly by those parties having counsel or offices in the District'of Columbia metropolitan area.
Other filings may be made by regular mail on or before December 30, 1981.
In accordance with Judge Milhollin's instructions, the schedule for the distribution and filing of documents contained in Licensee's proposal.has been discussed by counsel for Licensee with counsel for the NRC Staff.
Working out the proposed schedule has necessitated a one day delay in the submission of Licensee's proposal.
