Appendix A NOTICE OF VIOLATION Nuclear Cardiology Associates License No. 48-18826-01 As a result of the inspection conducttd on November 9,1981, and in accordance with the Interim Enforcement Policy, 45 FR 66754 (October 7, 1980), the following violations were identified:

1.

License Condition No. 14 requires that licensed material be possessed and used in accordance with statements, representations, and procedures contained in application received November 5, 1979; letters dated April 15, 1980, and May 4, 1981; and the ALARA Program dated August 15, 1980.

License application received November 5, 1979, states that the pro-cedures described in Appendb. D, section 2 of the NRC licensiag guide will be followed for calibration of the dose calibrator.

Appendix D, section 2, states that the daily constancy checks of the dose calibrator shall include a comparison of the actual value and the assayed value of a long lived source, such as a cesium-137 source.

Contrary to this requirement, your daily constancy checks of the dose calibrator failed to include a comparison of the actual value and the assayed value of your cesium-137 source.

This is a Severity Level V violation (Supplement VII).

License Condition No. 14 requires that licensed materiel be possessed and used in accordance with statements, representations, and procedures contained in application received November 5, 1979; letters dated April 15, 1980, and May 4, 1981; and the ALARA Program dated August 15, 1980.

License application received November 5, 1979, states that the pro-cedures described in Appendix I of the NRC licensing guide shall be followed for performing area surveys.

Appendix I states that weekly wipe tests of the laboratory and storage areas shall be performed.

Contrary to this requirement, weekly wipe tests of the laboratory and storage areas were nat performed since the date of license issuance.

This is a Severity Level V violation (Supplement VII).

l Appendix A 3.

10 CFR 71.5(a) requires that no licensee shall transport any licensed material outside of the confines of his plant or other place of use unless the licensee complies with the applicable regulations of the Department of Transportation in 49 CFR 170-189.

49 CFR 172.203(d)(iii)(iv)'and (v) states that the shipping tapers must include:

a.

The-activity contained in each package.

b.

The-label category applied to each package.

c.

The transport index~ assigned to each package.

Contrary to this ' requirement, it was learned through statement-cf a

licensee representatives and a review of records that the shipping papers for the packages shipped on September 1, 1981, October 5 and 28, 1981, and November 7, 1981, did not include:

a.

The activity contained in each package.

b.

The label category applied to each package.

c.

The transport index assigned to each package.

This is a Severity Level IV violation (Supplement V).

Pursuant to the provisions of 10 CFR 2.201, you are required to submit to this office within thirty days of the date of this Notice a written state-ment or explanation in reply, including for each item of noncompliance:

(1) corrective action taken and the results achieved; (2) corrective action to be taken to avoid further noncompliance; and-(3) the date when full compliance will be achieved. Under the authority of Section 182 of the Atomic Energy Act of 1954, as amended, this response shall be submitted under oath or affirmation.

Consideration may be given to extending your response time for good cause shown.
