Ar we 'unceratand it, the pri=nry matters under consideration by tbt: ASL3 relate to envirotunsultal conditiens that =ay be cauued by e,:tenc.lon of the Constructien Peruit, the reasons for construction delaye, and the cec:petency of the utility as evidenced by the delays.
In vitu of the fact that very little construction has taken place since the Construction Permit was issued in 1974, we believe other mattera varrant assessnent by the NRC in its censideration of extending the Perrit. Particularly i=portant, in our view, are the following:

The Bai21y facility will utilite a one-of-a-type 645 Pre, Mark II, SWR 5 design.
We anticipate that significant =edifications will be required by NRC, resulting in a substantial increase in capital costs over that estimated during the initial Construction Permit review.

The_ Quality.: Assurance Organization and Progra= identified in the Constructio'n Per=it Application vill require significant upgrading to meet existing standards.

The utility has only a s=all nu=ber of people with nuclear ex;crience.
The.:.ajority of these people are currently functioning in non-nunlear positions. We believe the overell c =petence of the utility to construct and operate the facility cay not catch the standarda which the 'NRC staff vould expect if a utility ven KL It~t1ng a new

application today.
4 As you know, both Chairman ~ Ahearne and Cc~issinner Gilinsky recently toured the Bailly site by helicopter with Bert Davis, Bill Axelson, and myself-to cbserve first band the characteristics of the location from a site suitability and energency planning standpoint.
During these over-flights, they both asked our views concerning this particular ette and whether we thought the project should be continued.
