Funds are not presently available 'or this procurement. The Govern-ment's obligation hereunder is contingent upon the availability of accropriated funds from which payment for the contract purposes can be made. BACKGROUND The Library 3 ranch of the NRC's Division of Technical Infomation and Document Control is charged with the responsibility of providing senior NRC management with a summary of relevant news clippings in a capsule femat. To accomplish this, the Library staff gathers news clippings and prepares the NRC Media Monitor for daily in-house distribution.
B.
OBJECTIVE To meet this requirement, the NRC requires contractor assistance and support in the gathering and clipoing of news artitM on a local and national basis. The required clippings mt.:t be only those relevant to the NRC mission.
C.
SPECIFICATICNS The contractor sh&ll furnish all necessary qualified personnel, facilities, equipment and materials (including newspapers and maga:ines) unless other-wise specified herein, to perform the following:
1.
SAME DAY DAILY AND WEEKENO NEWSPAPER Cf.IPPINGS The contractor shall review and furnish original clippings of all relevant infomation from the following newspapers, (including Saturday and Sunday publications) on a daily gqvernment work day basis:
New York Times Wall Street Journal Washington Post Washington Star Same day clips shall 'r.clude all relevant infomation contained in syndicatec coltsnns, local staff columns, editorials, and letters to the editor. See paragraph 3 below for a definition of " relevant infomation. " All same day clips shall be prepared and delivared by 8:30 a.m., Monday through Friday to 1717 H Street, N. W., Washington, D.
C., excluding national holidays. Weekend clios shall be delivered to the same address by 8:30 a.m. on the first Gowrnment workday following a weekend. Preparation of clippings shall be accomplished l
by cli::oing the news article from the newspaper source and pasting the clipping onto 81/2 X 11 inch, 20-weight white bond paper. There shall be a one inch margin on all four edges of the paper. Clippings may be mounted vertically or horizontally and shall be parallel,o either the bottom or side of the paper. Clipoings shall not be mounted diagonally nor at random. To the fullest possible extent, clippings shall be placed in columns running down the 11 inch dimension of the sheets. Clippings shall be placed on the mounting paper to fit as many as possible while leaving space between the articles and assuring readability. Each clipping shall identify its source and date of pubitcation. The contractor shall insure that no duplicate I

NATIONAL CLIPPINGS The contractt.c shall review and furnish original clippings of all relevant infomation from the amoximately 4000 national daily, weekly and weekend newspapers on a routine basis. Additionally, the contractor shall review and clip, on a routine basis, all relevant infomation from tha followirg three (3) national magazines:
Time Business Week Forture All clippings shall be deli ered to the NRC on a daily "M -clipped" basis. No clipping shall arrive at the NRC later than twenty (20) days following publication of the article. Clips shall include all relevant information contained in syndicated columns, staff columns, editorials and letters to the editor. See par 49t'aph 3 below for a definition of " relevant infomation." IFB RS-ADM-81-357 Page 19 ARTICLE II - PERIOD OF PERFORMANCE The period of performance shall connence on November 1,1980 and extend through October 31, 1981.
ARTICLE IV - OPTION TO EXTEND THE PERIOD OF PERFORMANCE The Government may, at any time within twelve (12) months after the award date of this contract, extend the contract for a period of twelve (12) months and require the contractor to furnish all or any part of Option Year items listed in Article I to the places and at the prices set forth herein. This option shall be exercised, if at all, by modification or telegraphic notice signed by the Contracting Officer and forwarded to the contractor within the twelve (12) month period specified aoove. The Government may give preliminary notice of its intent to exercise this option at least thirty (30) days before this -
contract is to expire.
Such preliminary notice shall not be deemed to commit the Government to renewal. If the Government exercises the option for renewal, the total duration of this contract, including exercisa of the option under this clause, shall not exceed twenty-four (24) months. Specifications for Option Year items are identified to basic year items specifications.
ARTICLE V - TECHNIC'L DIRECTION AND AUTHORIZED REPRESENTATIVE is hereby designated as the Contracting Officer's Prcject Officer (PO) for technical aspects of this contract. The PO is not autnorized to acorove or recuest any action which results in or could result in an increase in contract costs; or terminate, settle any claim or cispute arising unoer tne contract, or issue any unilatersi directive wratever.
The P0 is responsible for: (1) monitoring the contractor's technical progress, including the surveillance and assessment of performance, and recommending to the Contracting Officer changes in requirements; (2) interpreting scope of work; (3) performing te:hnical evaluation as required; (4) performing technical inspec-tions and acceptances required by this contract; and (5) assisting the con-tractor in the resolution of technical problems encountered during performance.
Within the purview of this authority, the PO is authorized to rcview all costs requested for roimbursement by contractors ano submit recommendations for approval, disaporoval, or suspension for supplies / services required under the contract. The Contracting Officer is responsible for directing or negotiating any cnanges in terms, conditions, or amounts cited in the contract.
ARTICLE VI - INSPECTION AND ACCEPTANCE A.

ARTICLE VII - PRESERVATION /PACXAGIllG/ PAC gig All materials delivered under this contract shall be afforded the degree of packaging (preservation and packing) required to prevent deterioration and/or damages due to ha: arcs of shipment, handling, and storage. Such packaging shall be accomplished in such a canner as to insure safe delivery at destination.
ARTICLE VIII - INCORPORATION OF REPRESENTATIONS AND CERTIFICATIONS The offeror's representations and certifications submitted in accordance herewith are hereby incorporated by reference.
ARTICLE IX - SUBCONTRACTS FOR WORK OR SERVICES No contract shall be made by the contractor w'ith any other party'for furnishing any of the work or services required herein without the prior written approval of the Contracting Officer. This provision shall not be construed, however, as requiring the prior approval of contracts of em;1oyant between the con-tractor and personnel assigned by the entractor to provide services hereunder.

Compliance shall also mean compliance with a schedule or plan ordered or approved by a court of competent jurisdiction, the Environmental Protection Agency or an air or water ponution control agency in accor-dance with the requirements of the Air Act or Water Act and regulations issued pursuant thereto.
(6) The term " facility" means any building, plant, installation, structure, mine, vessel or other floating craft, location, or site of operations owned, leased, or supervised by a contractor or subcontractor, to be utilized in the performance of a contract or ' subcontract. Where a location or site of operations contains or includes more than one building, plant, instanation, or structure, the entire location or site shall be deemed to be a facility except where the Director, Office of Federal Activities, Environmental Protection Agency, determinet that independent facilities are conocated in one geograpnical area.

In the event of the failure of the Catractor and the Contracting Officer to agree as provided in paragraph (d) upon the whole amount to be paid to the Contractor by reason of the termination of work pursuant to this clause, the Contracting Officer shall, subject to any review required by the contracting agency's procedures in effect as of the date of execution of this contract, determinen, on the basis of information available to him the amount if any due to the Contractor by reason of the termination and shall pay to the Contractor the amounts determined as follows:

The total sum to be paid to the Contractor under (1) and (2) of this paragraph (e) shan not exceed the total contract price as reduced by the amount of payments otherwise made and as further reduced by the contract price of work not terminated. Except for normal spoilage, and except to the extent that the Government shall have otherwise expressly assumed 3
the risk of loss, there shan be excluded from the amounts payable to the Contractor as provided in (e) (1) and (2) (1)' above, the fair value, as determined by the Contracting Officer, of property which is destroyed, lost, stolen, or damaged so as to become undeliverable to the Govermeene, or to a buyer ;ursuant to paragraph (b) (7).

with this contract; and (3) the agreed price for, or the proceeds of sale of, any materials, supplies, or other things acquired by the Contractor or sold, pursuant to the provisions of tais clause, and not otherwise recovered by or credited to the Govermnent.

It furrher provides that the Comptroller General of the Unicad States shall disallow any expenditure from appropriate funds for international air transportation on cther than a U.S. flag air carrier in the absence of satisfact.ory proof of the necessity therefor.

.40RK ORCER (a) The contracting Officer may, at any time, by written order to the Contractor, require tne Contractor to stop all, or any part, of the work called for by this contract for a period of ninety (90) days after the order is delivered to the Contractor, and for any further period at wnicn tne parties may agree. Any sucn order shall be specifically identified as a Stop Work Order issued pursuant to this clause. Upon receiot of sucn an order, the Contractor shall forthwith comply with its terms and take all reasonable steps to minimize the incurrence of costs allocable to the work cover 7d by the order during the period of work stoppage. Within a period of ninety (90) days after a stop work order is delivered to the Contractor, or within any extension of that period to wnica the parties shall have agreed, the Contracting Officer shall either:
(i) cancel the stop work order, or (ii) terminate the work covered by such order as provided in the "Cefault" or the " Termination for Convenience" clause of this contract.
(b)
If a stop work order issued under this clause is cancelled or the ceriod of the order or any extension thereof exoires, the Contractor shall resume work. An equitable adjustment shall be made in the delivery schedule or contract price, or both, and the contract shall be modified in writing accordingly, if:
- (i) the stop work order results in an increase in the time required for, or in the Contractor's cost procerly allocable to, the performance of any part of this contract, and (ii) the Contractor asserts a claim for such adjustment within thirty (30) days after the ena of the period of work stoppage; provided that, if the Contracting Officer decide) the facts justify such action, he may receive and act upon any such claim asserted at any time prior to final payment under this contract.
(c)
If a stao work order is not canceled and the work covered by sucn order is terminated for the convenience of tne Government, the reasonable costs resulting from the stop work order shall be allowed in arriving at the termination settlement.

The Contractor shall submit a copy of each article or other information to the Project Officer prior to puo11 cation or dissemination for public use.

DISSEMINATION OF CONTRACT INFORMATION The Contractor shall not publish, permit to be published, or distribute for public consumotion, any information, oral or written, concerning the results of conclusions made pursuant to the performance of this contract, without the prior written consent of the Contracting Officer.
(Two copies of any :aaterial proposed to be pu611shed or distributed shall be subnitted to the Contracting Officer.) Failure to comply with this clause shall be grounds for termination of this contract.

WORK FOR OTHERS Notwi;hstanding any ot.1er provision of this contract, during the tenn ot' this contract, the contractor agrees to forego entering into consulting or other centractual arrangements with any finn or organization, the result of which may give rise to an actual or apparent conflict of interest witn respect to the wrk being perfanned under this contract.
The contractor shall insure that all employees designated as key personnel if any, under this contract abide by the provisiens of this clause.
If the contractor believes with respect to itself or any sucn employee that any proposed consultant or other contractual arrangement with any firm or organization :nay involve a possible conflict of interest, the contractor shall obtain the written approval of the Contracting Officer prior to execution of such contractual arrangement.
