Dear Senator Schweiker:

I am wr1 ting in response to your memo of September 17,198% which fonvarded a letter froa your constituent Ms. Helen Hocker, dated September 5,1980.

The cocnent period for the " Draft Progranaatic Environmental Impact Statement Related to Decontamination and Disposal of Radioactive Wastes Resulting from March 28, 1979, Accident, Three Mile Island Nuclear Station, Unit 2 (PEIS)," has been extended to November ?0, 1980. That is a 45 day extension. Any ccanents received by that date will be considered in preparation of the Final PEIS.

With respect to Ms. Hocker's suggestion that put.lic funds be made available to intervenors in the hRC proceeding on the TMI cleanup.

I would sin. ply point out that use of FY 1981 funds for this purpose is currently prohibited ~ y statute.

P.L.96-367 (H.R. 7590), which c

passed the Senate by a vote of 83 to 9 and was signed into law by President Carter on September 30, prohibits the use of appropriated funds to pay the expenses of, or otherwise compensate, parties inter-vening in NRC regulatory or adjudicatory proceedings.

As you requested, I am returning Ms. Hocker's letter.
