Dear Mr. Keppler:

In. response to your letter dated July 15, 1974 (received July 17, 1974) the following reply is provided in accordance with 10 CFR Section 2.201.

The reply addresses the " Enforcement Action" section of the Summary of Findings in your letter.

Contrary to 10 CFR Part 71, non-exempt quantities of radioactive waste were transported in unapproved steel / lead casks

to the burial site ati Shetfield, Illinois.

Unapproved casks were used, because the station misunderstood the requirements of 10 CFR Part 71.

It was understood'that radioactive shipments made in j

accordance' with Department of Transportation regulations were exempt from 10 CFR Part 71. requirements.

After discussions with your inspector, it is understood that only less than Type B quantities of radioactive materials are exempt from 10 CFR Part 71 when Department of Transportation regulations are met.

Compliance witti 10 CFR Part 71 requirements was achieved on June 6, 1974.

The individuals involved with radioactive waste shipments from Dresden' Station were notified of the requirement to comply with 10 CFR Part 71.for this type of shipment.

Since June 6, 1974, no Type B quantity shipments have been made in unapproved packaging.

To ensure continuing conformance with 10 CFR Part 71, the Dresden Station radioactive material shipping procedure will be revised to indicate specifically the condition which allows exempting a shipment from 10 CFR Part 71.

This revised procedure will be imple.nented by Octobe'r 1, 1974.

The inspection report was reviewed for proprietary information and none was identified.
