O Appendix A MOTTCC OF VIOLATICN Commonwealth Edison Company Docket Nos.50-010; 50-237; 50-249 Based on the inspection conducted on June 14-17, 1977, it appears that certain of your activitics were in noncompliance with NRC requirements, as noted below.

Items 1 and 2 are infractions, and item 3 is a deficiency.

1.

Contrary to 10 CFR 50, Appendix B, Criterion XVI and the licensce's Quality Assurance program, inadequate corrective action to preclude repetition was taken when the license-determined that the Unit 2 APRM/ RUM flow bias indication exceeded 1007. on both channels, resulting in a nonconser-vative flow bias scram setpoint. This condition was reported to the NRC in February, 1977 (LER 237/77-02) and again in April 1977 (LER 237/77-19). Criterion XVI states "In the case of significant conditions adverse to quality, the measures shall assure that the cause of the condition is determined and corrective action taken to preclude rep-etition.

Contrary to Te..'mical Specifications, Section 1.0.C.C.a and b, surveillance intervals for 5-specifi surveillances conducted on Units 2 and 3 were exceeded in February, 1977.

(Ref: LERs 237/77-0, and 249/77-06) Technical Specifica-tion 1.0.C.C requires:

(a) a maxinum allowable extension not to exceed 25% of the surveillance interval and (b) a total maximum combined interval time for any 3-consecutive intervals not to exceed 3.25 times the specified surveil-lance interval.

Contrary to Technical Specifications. Section 6.6.B.2.b, a condition leading to a plant shutdown (on Unit 3) re-

~ quired by a limiting condition for operation was not reported within the required 30-day tiac requirement.

The Unit 3 reactor was shutdown on April 6, 1977, as a result of excessive leakage in the primary containment.
