Dear Serntor Saxbe:
I am pleased to respond to your referral of reptember 18, 1969, concerning a letter you received from 16. Bruce M. Hankins. Mr. Hanicins raises the question as to what contmls are being exercised on the -
discharge of heated water for the proposed Davis-Besse facility to be located on the shore of Lake Erie.
Under the Atac:ic Energy Act, the Cocrission has the msponsibility' and authority for the licensing ard regulation of trxlear reactors from the standpoint of radiological health and safety. 'Ihe AEC presently lacks authority to irpose restrictions regarding the therm 1 effects 1
of discharges fmm licensed nuclear facilities. Licensing by the ABC, however, does rot miieve the applicant from bei.y subject to the appropriate jurisdictions in other amas which would also be involved if the plant wem fueled by coal, oil, or other nonnuclear reans.
Each state, of course, has the same autreity to deal with themal effects from nuclear power plants as it does from fossil-fueled power plants unless in sone way restricted by state law.
In this connection, the Water Quality Act of 1965 provides a

cor:prehensive proc; ram through which water quality standanis,' including standards on themal effects, are developed-by the states and approved by the Secretary of the Interior. Urder this program, the recretary of the Interior has approved water quality standards for Iake Erie.

Department of the Interior accreendations and ccm.ents on all applications for construction permits.. 'Ihe report by the Departmmt of the Interior's Fish and Wildlife Service also unkes reconmendations on nonradiological matters, inchMng thermi effects of the discharge i
of coolant water in the mrine envircrrent. A copy of this apart is sent to the' applicant, calling attention' to the Service's recomenda-tions.oonceming potentini nonradiological effects and urging cooperation'with the appropriate federal and state agencies. This

of the potential effects of the plent upon Lake Erie. They have engaged tN Great I23:es Reser.rch Division, Institute of Science and Techno1 cry, of the thiversity of Michigan, under Dr. J. C. Ayers, to conduct this study. The applicants have'already been in contact with state and federal agencies who will part'lcipate in the program as it develops. The applicants state that the primry purpose of the attsfy is to co]1ect linnological data to detemine the reans by which established radiological and thertnl discharge starviards will be ret.
