l A public hearing before an atomic safety and licensing board was concluded on February 12, 1971, in Port Clinton, although the board has not yet i
issued its initial decision as to whether a construction permit for the plant should be granted. The AEC's procedures for considering applica-i l
tions for nuclear power plant permits and licenses are described in the enclosed booklet, " Licensing of Power Reactors."
As required by the AEC regulations, a notice of hearing was published in the Federal Register on November 4,~1970.
November IS, 1970, was set forth-in the notice of hearing as the closing date for filing a petition to l
intervene or to make a limited appearance. The chronology of the hearing is as follows. December 8-10, 1970; January 5-7, 1971; January 25-29, 1971; and February 8-12, 1971, in Port Clinton, Ohio.
In each instance the Atomic Safety and Licensing Board postponed the hearing to allow intervenors (the Coalition, L.I.F.E., and Glenn Lau) additional time to complete preparation of their cases.
>1rs. Handy expressed concern about the construction activities going on at the Davis-Besse Nuclear Power Station. The Toledo Edison Company has i
been granted an exemption frem the provisions of 10 CFR Part 50, paragraph 50.10(b), (copy enclosed) of the Commission's regulations to perform cer-tain foundation work for the nuclear portion of the plant prior to the issuance of a construction permit.
The exemption was not granted until af ter the staf f and the Advisory Committee on "eactor Safeguards had completed their reviews of the application for a construction permit.
The granting of this exemption will have no bearing upon the subsequent granting or denial of a construccian pernit for the proposed Davis-Desse Nuclear Fower Station, and any worm performed pursuant to this exemption shall be performed entirely at the risk of the companies involved.
!!rs, llandy also expressed concern about the effects of the plant on Lake Erie. On July 31, 1970, the Toledo Edison Company announced that it would utilize a natural draf t cooling tower system which will dissipate the heat from the condenser directly to the atmosphere rather than into Lake Erie. For further discussion of the cooling tower system, we would call her attention to pages 11 to 13 of the Applicant's environmental i
report, and pages 61 to 62 of the AEC regulatory staff's detailed on-vironmental statement (copies enclosed).

and the ACRS have advised thee the plant can be built and operated j
without inadme risk to the public.
