4 APPENDIX A NOTICE OF VIOLATION Consolidated Edison Company of Docket No. 50-247 New York, Inc.50-003 License No. DPR-26 DPR-5 Based on the results of an NRC inspection conducted on July 11-14, 1978, it appears that one of your activities was not conducted in' full compli-ance with NRC regulations as indicated below.
This item is an infraction.
10 CFR 71.3, " Requirements for license", states, "No licensee sub-ject to the regulations in this part shall (a) deliver any licensed materials to a carrier for transport or (b) transport licensed material except as authorized in a general license or specific license issued by the Commission, or as exempted in the part."
Contrary to this requirement, on May 19, 1978, a package of li-censed material was delivered to a carrier for transport without being authorized by a general or specific license.
The weight specification in the Certificate of Compliance associated with this package (Certificate No. 6144) was exceeded by 4965 pounds and accordingly the shipment which would otherwise qualify for a general license under 10 CFR 71.12 did not qualify.
