Dear Mr. Hartley:
This refers to the special inspection conducted by D. G. Wiedeman of this office on February 25 and 27, 1992, November 10, 1992, and April 16, 1993, of the property adjacent to the former Hartley & Hartley Landfill (now owned by Waste Management of North America and Michigan Department of Natural Resources), and to the discussion of our findings with you and your son, Ty Hartley, on April 16, 1993.
The enclosed copy of our inspection report identifies areas examined during the inspection. Within these areas, the inspection was an examination of the activities conducted on this site, review of historical documents that pertain to the origin of the radioactive contamination, and an assessment of the radiological significance of the contamination and site security.
During the inspection, our inspector determined that your property was contaminated with licensable quantities of NRC source material (thorium-228 and thorium-232) that were improperly disposed of during the early 1970's from the former Wellman-Dynamics Company of Bay City, Michigan.
Further, this contaminated area of your property was not confined, restricted, or posted to warn members of the public of the hazards associated with access to the property.
Within 30 days from the date of this letter, please advise this office of your intentions to post and restrict access to this site and your ultimate plan to properly dispose of this material.
In accordance with 10 CFR 2.790 of the Commission's regulations, a copy of this letter and the enclosed report will be placed in the NRC Public Document Room.
We will gladly discuss any questions you have concerning this inspection.
