Dear Congressman Hayes:

This is in response to your letter to James L. Milhoan, Regional Administrater in the Commission's Region IV Office, dated April 21, 1993, in which you transmitted a letter from a constituent of yours, Jody Hoag.

Your constituent expressed a concern about a proposed NORM facility near Lacassine, Louisiana, and indicated a need for experts from the Commission, among other agencies, to testify on the subject at a public hearing scheduled for April 26, 1993, in Jennings, Louisiana.

As discussed in a telephone conversation of April 26, 1993, between your staff and Thomas Combs of our Office of Congressional Affairs, the Nuclear Regulatory Commission has no regulatory jurisdiction for Naturally Occurring Radioactive Material (NORM).

TN federal agency that has responsibilities for such material is the Environmental Protection Agency (EPA). Since the IPA was one of the agencies mentioned, along with the Commission, in your constituent's letter, we presumed you have also contacted them.

If we can be of any future assistance in an area in which we have regulatory jurisdiction, we will be happy to do so.
