I Commissioner de Planque's comments on SECY 93-034.
i I approve the issuance by staff of Management Directive 3.5,
" Announcing Meetings Open to the Public" (as modified by EDO's March 31, 1993 response to Commissioner Curtiss' questions) to codify existing staff practices.
However, I agree with Commissioner Curtiss' comment in his March 9th memorandum to EDO that, "The proposed policy is an amplification upon, and exoansion of, earlier policy pronouncements..." (emphasis added).
In particular, the 1978 Policy Statement is very limited in scope.
In view of this, I agree a revision to the 1978 Policy Statement is in order.
Therefore, I disapprove the staff's proposal to simply notice a change in policy in the Federal Register.
Taking into consideration some of the concerns expressed by the American Mining Congress and balancing that with a desire for public participation in carrying out NRC programs, the Directive should be published in the Federal Register as a proposed change to the 1978 Policy Statement and the public invited to provide comments upon it.
