Dear Mr. Stanton:

This is in response to your letter of March 15, 1993, requesting that the Narragansett Indian Tribe be part of any agreement / arrangement pertaining to the regulation of groundwater at the United Nuclear Corporation (UNC) site in Rhode Island. The U.S. Nuclear Regulatory Commission has made a preliminary determination that the radionuclide concentrations in the site groundwater meet the NRC's unrestricted release standards.

However, to reconfirm this, the NRC is currently arranging for the resampling of site groundwater wells.

If the resampling does not confirm that the site-groundwater meets the NRC's unrestricted release standards, NRC will inform the Narragansett Indian Tribe and the State of any continued NRC regulation of groundwater contamination at this site.

If the resampling does confirm that the site groundwater meets the NRC's unrestricted release standards, the NRC would not anticipate further regulation of the groundwater contamination at this site.

With respect to nonradiological contamination in groundwater, UNC is in the process of developing a monitoring plan for the site. This monitoring plan will be presented to the State of Rhode Island, Department of Environmental Management (DEM) for their review. Once DEM accepts UNC's monitoring plan for the nonradiological contamination at the site, NRC plans to terminate UNC's license.

If you wish to be included in UNC's and DEM's arrangement on the further regulation and monitoring at the site, you should contact them regarding this matter.

The NRC's license termination process will include a Final Environmental Assessment, a Safety Evaluation Report, and notification in the Federal Reaister.
