SECY-93-032 - 10 CFR PART'Sh RULEMAKING ON ENVIRONMENTAL REVIEW FOR RENEWAL OF NUCLEAR POWER PLANT OPERATING LICENSES l

The Commission (with all Commissioners agreeing) has approved the modifications'in the proposed rule which have been negotiated l

with CEQ and EPA as described on pages 2-4 of the subject-paper.

l The staff should develop options for responding to the_. state

-l commenters who expressed concerns about the preemption of state

.[

regulatory authority relative to the need for generating'_

-l capacity, alternative sources of energy, utility costs and cost-benefit balancing in NRC environmental reviews.

The_ options.

f paper should address in detail the significant legal and policy aspects of these issues.-

The Commission (with the Chairman and Commissioners Rogers and 1
