GE-VALLECITOS FINANCIAL ASSURANCE FOR DECOMMISSIONING (TAC NO. L21358)

On March 21, 1991, Mr. R. W. Darmitzel, Manager, Environmental Programs for GE, submitted a letter briefly describing their decommissioning financial posture for GE-Vallecitos Nuclear Center as well as other GE sites.

This submittal responds to the Nuclear Regulatory Commission's technical and financial regulations for decommissioning licensed nuclear facilities which were published in 53FR24018 dated June 27, 1988.

Subsequently, TAC NO. L21358 was opened to track this action.

While researching the appropriate action for responding to this letter, it became apparent that no response is required; and it is appropriate to treat the submittal as only an informative letter.

The reason for this is there are other licensing actions taking place such as:

action concerning exemptions from financial assurance regulations, GE and Westinghouse rulemaking requests, and finally, associated petitions being handled at the Commission level, Office of Nuclear Regulatory Research, and the Decommissioning and Regulatory Issues Branch, LLWM/NMSS.

Any action we might take on this issue, at this time, could be inappropriately interpreted by the licensee.

Further, I discussed the appropriate response with the Office of General Counsel (Robert Fonner); and they agreed that any action we take may " muddy the waters."

Accordingly, the casework Control No. 120F and TAC N9. L21358 is being closed out by this memo and no further action is necessary.

Future action will depend upon subsequent licensee submittal associated with financial assurance and directed to the appropriate division.
