ORDER MODIFYING AN ORDER IMPOSING A CIVIL PENALTY
- $ 5,000 By EN 92-087a dated February 3, 1993, the Commission was notified of the intent of OE to issue an Order Imposing A Civil Monetary Penalty in the amount of $7,500 to Capital Materials Testing, Inc.
The action was based on a violation involving the failure to adequately perform a survey of a radiographic device after the completion of a radiographic exposure.
The licenseo provided additional information on the licensee's correct 3ve actions in a letter dated March 25, 1993 and requested consideration of the licensee's ability to pay.
After careful consideration of the licensee's response, the staff has concluded that the violation did occur as set forth in the Notice of Violation and Proposed Imposition of Civil Penalty.
However, the NRC staff has determined that mitigation of an additional $2500 for the licensee's corrective actions in accordance with the Enforcement Policy is warranted.
Accordingly, an order Modifying an Order Imposing a Civil Penalty in the amount of $5,000 has been issued today.
Under the terms of the Order, the licensee may within 30 days of the date of the Order, pay the civil penalty, make arrangements for payment over time, or request a hearing.
