Houston Lighting and Power (EA 92-175, EA 93-023 and (EA 93-047)
(South Texas Units 1 and 2)
Docket Nos. 50-498 and 499 Subiect:
PROPOSED IMPOSITION OF CIVIL PENALTIES - $175,000 This is to inform the Commission that three Notices of Violation and Proposed Imposition of Civil Penalty in the cumulative amount of $175,000 will be issued on or about April 19, 1993 to the Houston Lighting and Power Company.
The first of these three separate actions is based on a number of violations of established procedures which resulted in the failure to inform NRC licensed operators in the control room of potentially significant conditions that could have affected the operation of I
the plant.
Because the failures to follow established procedures.
involved plant management personnel, these violations have been classified as a Severity Level III problem.
The base civil penalty of $50,000 has been escalated 50 percent to $75,000 after finding 50 percent mitigation appropriate for the licensee's corrective action and 50 percent escalation appropriate for NRC identification of the violations and 50 percent appropriate for the licensee's prior opportunity to identify one of the violations.
The second of the three actions is based on numerous examples of t
personnel errors involving individuals working on equipment on the wrong train or wrong unit.
While none of these errors resulted in adverse safety consequences, collectively they represent a significant regulatory concern and have been classified as a Severity Level III violation.
In recognition of the licensee's corrective actions the civil penalty has been reduced by 50 percent of the base civil penalty to $25,000.
The third action is based on the licensee's failure to take corrective actions for a failed motor on a motor operated valve in the Unit 2 Low Head Safety Injection System.
The violations involved in this action have been classified at Severity Level III because (1) a safety-related valve went unrepaired for 18 months despite multiple opportunities to recognize the significance of the problem, and-(2) operations personnel did not recognize the technical specification implications of operating the reactor with the valve inoperable.
The civil penalty in this case has been escalated to $75,000 after partially offsetting escalation for the duration of the inoperable valve and the licensee's inadequate corrective actions with mitigation for the licensee's aggressive identification of the root causes of this self-identifying event.
