Gentlemen:
I am responding to your letters of February 5,1993, February 16, 1993, and
August 13, 1992, seeking relief from payment of the annual fee for License
50-29002 01, Invoice AM07230-92.
The Commission is considering your
correspondence as an exemption request.
The bases for your request are:
1) the licensed meter has not been used for
the past two years effective January 1991 and you have no intention of using
it; 2) you have paid all fees for 1991; 3) you believe you told someone on
the phone last year of your intent to cancel the license but did not send a
letter confirming your intent;
4)
it is a serious monetary burden to pay the
license fee when you are not doing any business to earn money to pay for the
license; and 5) your August 13, 1992, letter stated you were in the process
of selling the equipment and should not require the license after it is sold.
As stated in the final revision to the Commission's fee regulations in 10 CFR Parts 170 and 171 for FY 1992, which was published in the Federal Register
July 23, 1992, the Commission exempted from the FY 1992 annual fee those
licensees and holders of certificates, registrations and approvals who either
filed for termination or for a possession only/ storage license during the
period October 1, 1991, through December 31, 1991.
Our records show that on March 19, 1992, we received your notification of a
change of address, and on May 20, 1992, you notified us of your company's name
change. Neither of these submittals requested that the license be terminated
or be amended to authorize possession only.
Further, following a telephone
conversation with you on August 13, 1992, you were faxed a note concerning the
balance due on Invoice AM08616-91 for the FY 1991 annual fee and stating that
with the payment you should submit information regarding termination of the
license.
Your August 13, 1992, letter submitting the payment stated that you
were in the process of selling the equipment and should not require a license
after it sells.
To date, the Commission has not received a request from you
to terminate the license.
Since you stated that the licensed material has not been used for two years
and that you are in the process of selling the equipment, the Commission will
accept, consistent with the appropriate regulations in 10 CFR Part 30, a
written request from Phukan Consulting Engineers and Associates, Inc. to
terminate License 50-29002-01 or to amend the License to authorize

possession / storage only as being timely filed for purposes of avoiding the FY
,
1992 annual fee if it is submitted within fifteen (15) days from the date of
this letter.
Enclosed is an NRC form 314, Certificate of Disposition of
Materials, for your use if you want to terminate the license.
A request to
terminate the license would not be subject to an amendment fee; however, if
you request an amendment to place the license in a possession / storage only
status, your request must be accompanied by the appropriate amendment fee
specified in fee Category 3P of 10 CFR 170.31. The current amendment fee is
$410.

If you need additional information on the requirements for terminating the
license or amending the license to authorize possession / storage only, please
contact the Region V licensing staff at (510) 975-0200.
If you are unable to file for termination or possession / storage only within

fifteen days from the date of this letter, Invoice No. AM07230-92 must be paid
in full.
The amount due through April 9, 1993, is $2,498.72, which includes
interest, penalty and administrative charges.
